Mediation & Arbitration Law
Mediation is a process where the parties to a dispute (and their attorneys) negotiate a settlement of their dispute with the assistance of a neutral third party (the mediator). The mediator assists the parties in reaching an agreement and ultimately, a settlement of the case. In cases that try mediation, 99.8% of those cases settle. That leaves only 0.2% of cases that go to a trial before a judge and jury. You need an attorney that knows how to stand up for your rights in mediation. Our attorneys are all certified mediators who understand the process.
Arbitration is very different from mediation. In arbitration, the parties submit their case before a neutral third party who sits as a judge of the dispute. The main difference between a traditional lawsuit and an arbitration is who decides. In a traditional lawsuit, the judge decides. In an arbitration, the arbitrator decides. The parties to the dispute often pick the arbitrator and the disputes are often resolved quicker and cheaper than before a judge. Our attorneys at Russell, PLLC are all arbitrators themselves and have presided over multiple complex arbitrations.
If you're in the middle of a dispute and would like to submit it to mediation, or if you're facing a dispute that is covered by mandatory arbitration, call our attorneys.
